European Commission adopts new guidelines on free movement of goods

While some Member States are introducing measures restricting the free movement of persons, and incidentally of goods, as part of the fight against the pandemic, the European Commission adopted, on Friday 5 March, three policy documents aimed at facilitating the free movement of goods.

For example, the guidance document on the implementation of the Mutual Recognition Regulation (see EUROPE 12144/6) provides additional information, in particular on the mutual recognition declaration, the assessment of goods, the support services provided by the SOLVIT centres (the problem-solving network in the Internal Market) and the Product Contact Points (PCPs).

As for the document on market surveillance of goods, it clarifies Article 4 of the new Market Surveillance Regulation (see EUROPE 12619/23), which aims to strengthen market surveillance in the EU for products entering the European market, in particular those sold online.

Finally, the guidance document on the application of the Treaty provisions on the free movement of goods (Articles 34 to 36 TFEU) provides an overview of the case law of the Court of Justice of the EU (CJEU) on obstacles to the free movement of goods which hamper operators in the Single Market.

It should be noted that these three approaches are part of the March 2020 Action Plan for the better implementation and enforcement of single market rules (see EUROPE 12443/7).
