The European Commission has decided, Thursday 3 December, to bring an action before the Court of Justice of the European Union against Ireland for failure to transpose the Framework Decisions on mutual recognition concerning the rights of suspects and prisoners into its national law.
They are Framework Decision (2008/909/JHA), which aims to facilitate the social reintegration of convicted EU citizens by allowing them to serve their sentence in their home country, and Framework Decision (2009/829/JHA), which allows suspects awaiting trial in another EU country to return to their country of residence until the start of their trial.
Ireland has notified the Commission of draft laws aiming to transpose the Framework Decisions. “However, a draft law cannot be considered a transposition measure”, the Commission says.
Following a letter of formal notice in January 2019 and reasoned opinions in July 2019, the European Commission has decided to take the next step by referring the matter to the Court of Justice. (Original version in French by Marion Fontana)
