On Thursday 19 December the European Commission published a notice of initiation of an expiry review of the anti-dumping measures. These duties related to imports of Chinese sulphanilic acid.
Following the announcement of the impending expiry of the anti-dumping measures on sulphanilic acid products originating in China, Bondalti Chemicals S.A., representing 100% of the total EU production of this product, called for a review by the Commission. Indeed, it argued that the expiry of the measures would be likely to lead to a continuation and recurrence of dumping and injury to the Community industry.
The complainant substantiated its complaint on the basis of the China specific report (see EUROPE 11918/17), which indicates significant intervention by the Beijing government. The applicant also claimed that the production of sulphanilic acid in China was export-orientated and referred in this respect to reports of the US International Trade Commission.
The Commission will base its allegation of dumping on a comparison with a constructed normal value. This value is based on undistorted costs of production and sale in an appropriate representative country and on the export price of the Chinese product to the EU.
