Transatlantic agreement on access to electronic evidence, several substantive issues still to be resolved

The conclusion of an agreement between the EU and the United States on cross-border access to electronic evidence still seems a long way off. A report produced by the European Commission on the second round of negotiations, held in Washington on 6 November (see EUROPE B12348A17), identifies several difficulties and substantive issues that remain to be resolved.
