On Tuesday 24 September, the General Court of the European Union annulled EU Council Decision 2018/333 extending sanctions from March 2018 to March 2019 relating to the misappropriation of Ukrainian State funds by former President Viktor Yanukovych and his son Oleksandr (Cases T-300/18 and T-301/18).
On the basis of case law, particularly the Azarov judgment (see EUROPE 12164/20), the General Court is of the opinion that the EU Council has not sufficiently verified that the decision of the Ukrainian judicial administration to initiate criminal proceedings against the two applicants, on which the maintenance of the restrictive measures against them was based, was taken with due respect for the right of defence and the right to effective judicial protection.
