The European Commission sent a reasoned opinion to Cyprus on Thursday 25 July to ensure that Nicosia complies with the rules of the Trade Secrets Directive (Directive 2016/943).
The Directive, which was painfully adopted in 2016 and which precipitated the drafting of the Whistleblowers Directive (see EUROPE 11478/6), aims to harmonise the legal protection of trade secrets throughout the territory of the European Union, as well as sanctions.
However, Cyprus has yet to communicate its transposition measures to the European Commission, although the deadline was 9 June 2018. The country now has two months to provide satisfactory answers to the guardian institution of the Treaties, failing which the latter could refer the case to the Court of Justice of the European Union (CJEU).
