25/07/2019 (Agence Europe) – On Thursday 25 July, the European Commission brought an action for failure to fulfil obligations before the Court of Justice of the European Union (CJEU) against Belgium for failure of the national authorities to comply with a judgment for failure to fulfil obligations of the same CJEU. On 12 April 2018, the Court found that the national provisions relating to rental income, which differ depending on whether or not the property is located abroad, were contrary to EU law. Since Brussels has not taken any action to remedy this situation, the Commission is asking the Court with this action to impose financial penalties on the Belgian authorities for failure to fulfil obligations.
