Non-ETS burden-sharing, interinstitutional talks to resume after COP23

The scale of flexibility to be offered to the member states when it comes to respecting their climate obligation in sectors not covered by the EU's carbon trading system (ETS) (transport, agriculture and waste) – a subject of disagreement between the European Parliament and Council – will determine the outcome and ambitions of the interinstitutional negotiations currently under way between the European Parliament and the Estonian Presidency of the Council of the EU, attended by the European Commission.

The talks will resume on 21 and 22 November after COP23 (Bonn, 6-17 November) and will cover the regulation on burden-sharing for reducing greenhouse gas emissions by the EU28 in sectors not covered by ETS for the 2021-2030 period and the separate draft Lulucf regulation on land use, agriculture, and forestry’s contribution to ensuring balance in greenhouse gas emission and absorption. 

These two key items of legislation for implementing the Paris Climate Agreement aim, for sectors that generate 60% of greenhouse gas emissions, for a 30% cut in greenhouse gas emissions by 2030 (on the 2005 level) as a contribution to the EU's climate objective of reducing emissions by at least 40% by 2030 on the 1990 levels.

Non-ETS burden-sharing.  Following the political agreement reached at the Environment Council on 16 October (see EUROPE 11886, 11884), an initial trialogue meeting took place on 26 October where both sides set out their positions and priorities.  The next trialogue will take place on 21 November.

Lulucf regulation.  Since the first contact among negotiators on 19 October after the political agreement was reached at the Environment Council (see EUROPE 11884), work has been ongoing at technical level.  The next trialogue meeting of negotiators is scheduled for 22 November.

The following trialogues on these two items of legislation will take place before the 19 December Environment Council, but the dates have not yet been set.  (Original version in French by Aminata Niang)
