28/06/2016 (Agence Europe) - Commission will have to recalculate fines on Portugal Telecom and Telefónica. On Tuesday 28 June, the General Court of the EU confirmed the legality of the European Commission's 2013 decision imposing fines on PT (formerly Portugal Telecom) and Telefónica for having concluded an agreement of non-competition on the Iberian telecommunications markets and subsequently breaching EU rules banning anti-competition agreements (see EUROPE 10770). In its ruling (Joint cases T-208/13 and T-216/13), the Court, however, called on the Commission to recalculate the amount of the two fines (€66.8 million and €12.2 million). The Commission will have to exclude the calculation of the fines from the sales of a company corresponding to an activity is unlikely to be in competition with another company during the period of applying the litigious clause.
