05/03/2015 (Agence Europe) - Telephone memory cards may be subject to private copying levy. The Court of Justice ruled on Thursday 5 March (case C-463/12) that there is nothing in principle to prevent mobile telephone memory cards being subject to the private copy levy, even though this levy is not charged on internal memories in other devices, such as MP3 players and iPods, as is the case in Denmark. The requirements relating to fair compensation need not necessarily be identical for these two media but it is for national courts - in Denmark in this case - to determine whether the media are comparable and whether the difference of treatment can be justified. The Court suggested that it would have to be checked whether memory cards, by virtue of the fact that they can be extracted from the device, may make it easier to produce further copies of the same work on other media.
