Brussels, 05/02/2014 (Agence Europe) - Barely half of all member states are applying the provisions on the detention of Europeans in member states where they have not been sentenced. This is the observation made on Wednesday 5 February by the Commission in a report assessing implementation of the framework decisions covering the transfer of prisoners, probation, alternative penalties and the decision on the European supervision order. The rules, adopted by the member states by unanimity between 2008 and 2009, should have been implemented on 5 December 2011, 6 December 2011 and 1 December 2012 respectively at the latest. So far, 18 member states have applied the decision on the transfer of prisoners (Bulgaria, Cyprus, Germany, Estonia, Greece, Spain, Ireland, Lithuania, Portugal, Sweden have not executed this decision), 14 have applied a decision on probation and alternative penalties (Cyprus, Germany, Estonia, Greece, Spain, France, Ireland, Italy, Lithuania, Luxembourg, Malta, Portugal, Sweden, United Kingdom are the exceptions) and 12 countries have applied the European decision on the European supervision order (Belgium, Bulgaria, Cyprus, Germany, Estonia, Greece, Spain, France, Ireland, Italy, Lithuania, Luxembourg, Malta, Portugal, Sweden and the United Kingdom are still behind on this). As of 1 December 2014, the Commission may launch infringement procedures, for which it does not yet have the remit. (SP/transl.fl)
