Glyphosate ruling goes against Commission

Brussels, 09/10/2013 (Agence Europe) - On 8 October, the General Court of the EU (case T-545/11) annulled the European Commission decision of August 2011 to refuse access by environmental organisations PAN Europe and Greenpeace Nederland to an assessment report containing information on the precise composition of the pesticide Glyphosate, including information on impurities, additives to the product and the consignments used in the safety tests ahead of marketing the product. The Court ruled that the Aarhus Convention (access to information, public involvement in the decision-making process and access to justice on environmental matters) implies that any document on “emission in the environment” must be communicated without restriction. The Court took the view that, since the impurities and other additives are sprayed with the active substance, they have to form part of the concept of “emission in the environment” and access to relevant information cannot be refused by the Commission.
