Brussels, 28/01/2013 (Agence Europe) - The European Commission called last week on the Court of Justice of the EU to fine Portugal on the grounds that it has failed to comply with the 2010 ruling of the Court calling upon it to comply with EU rules on telecommunications, particularly those governing the designation of the universal service provider. The Commission has suggested imposing a fine set at €5277.30 a day for the period between the date of the Court's 2010 ruling and the date of the second ruling. The Commission's decision to bring Portugal back before the Court for the member state to be fined follows an earlier decision to bring the matter before the Court, which was taken by the Commission in March 2010 (see EUROPE 10580). The Commission took account of progress made since then by the Portuguese authorities, which have, amongst other things, published calls for tenders; it has therefore proposed a reduced flat-rate fine.
