Move to common sales law?

Warsaw, 16/11/2011 (Agence Europe) - In the field of European contract law, the management of barriers to growth of the internal market is strewn with problems. Changes are now planned to European law, which aim to facilitate the conclusion of sales contracts on the internal market. Online transactions for European consumers and companies will also be affected by this initiative.

A meeting took place on this subject in the Polish capital, attended by European Commissioner for Justice Viviane Reding. Krzysztof Kwiatkowski, the Polish minister for justice, stated: “As the representative of the Presidency, I am pleased that Poland is beginning discussions on this project, although I am aware that the question of a common European law on sales is difficult. This is a very serious project, which will require a lot of effort to be made during the legislative process ahead of us.”

The European Commission proposal has provoked a number of different opinions, the minister conceded, before adding, nevertheless, that “its voluntary nature, and at the same time its broad range of applications, leads us to believe that we have a new way ahead for us in the area of European private law”. The Polish Presidency is committed to carrying out a very precise legislative undertaking on the project. Kwiatkowski explained that “this is one of our priorities and we want to overcome the discrepancies between the different systems governing contracts in the European Union”.

Commissioner Viviane Reding emphasised that common European sales law involved major goals and would also have a potential impact on the real economic situation affecting European Union citizens. (VW/transl.fl)
