01/12/2008 (Agence Europe) - The European Commission has decided to take Germany before the Court of Justice over a public service contract for the disposal of biodegradable and green waste that the municipality of Bonn had awarded to a private undertaking without a competitive tender procedure. The contract, sealed in 1997 and valid till 2016, stipulates that the municipality has to dispose of household waste furnished by the private partner in its incineration plant, while the private partner undertakes in turn to treat bio-waste furnished by the municipality in its composting plants. The Commission considers that, with regard to bio-waste, the municipality acts as a contracting authority buying services from operators in the market. (C.D./transl.jl)
