01/12/2008 (Agence Europe) - On Thursday 27 November, the European Commission sent a reasoned opinion to Spain regarding rules relating to changes in contracts after these have been awarded, as per the new Spanish law on public procurement (Ley 30/2007 de contratos del sector público, LCSP). The Commission considers that some aspects of this regime are not in line with Community law on public procurement (Directive 2004/18/EC). In particular, the Commission notes that the LCSP allows adjudicating bodies to amend public procurement conditions after contracts have been signed, without the changes being specified in the contract. If no adequate response from the Spanish authorities is received within two months, the Commission will refer the matter to the Court of Justice. (C.D./transl.jl)
