08/05/2008 (Agence Europe) - On Tuesday 6 May 2008, the European Commission decided to lodge a case against Poland at the European Court of Justice over the incorrect transposition by Poland into its national law of EU legislation on the EU system to monitor the traffic of ships in EU waters. The Commission found that Polish legislation did not adequately incorporate the provisions of Directive 2002/59/ECon the reporting of accidents and incidents at sea, notification of dangerous and polluting goods and exclusion of all recreational vessels from the scope of the Directive although they should have been incorporated before Poland joined the EU (1 May 2004). The directive is a part of the second maritime package and includes the obligation to inform the maritime authorities if a ship is carrying dangerous or polluting goods. The directive also provides for the monitoring of hazardous ships and for the intervention in the event of accidents at sea. (A.By.)
