Brussels, 10/04/2008 (Agence Europe) - According to the Commission, the amendments proposed by the Lower Saxony region to the “Volkswagen law” are insufficient in getting this law to comply with the Court of Justice decision of 23 October 2007 (EUROPE 9529). In a letter sent to the German authorities on 9 April, the European Commissioner for the internal market, Charlie McCreevy, was particularly critical of the fact that the clause allowing anyone who held a 20% share in VW would be able to block certain “significant decisions” (EUROPE 9583). The Lower Saxony region has a 20.1% stake in the company. In a response dated 10 April, the Regional Minister for Justice, Brigitte Zypries (Social Democrat) declared, “I do not recognise that the blocking minority, which is a departure from the general share law, blocks the free movement of capital”. The Commissioner is not ruling out the possibility of taking Germany to the Court of Justice but is “relying on the German authorities to do the right thing”. (C.D)
