28/03/2008 (Agence Europe) - A Swedish immigration court has refused to extradite an Iraqi asylum-seeker to Greece, following concerns that he would not receive proper treatment in Greece (the asylum seeker in question is disabled). Before requesting asylum in Sweden in November 2007, the Iraqi had fled to Greece from Iraq and then returned to Iraq for a short period. Under the EU's Dublin II rules, his asylum request should be examined by the Greek authorities because Greece was the first EU member states entered by the Iraqi. Sweden's Migration Board decided to extradite him to Greece but the disabled Iraqi appealed against the decision, on the grounds that conditions for asylum seekers in Greece are particularly difficult for the disabled. The appeals court ruled in favour of the applicant, saying that it was up to Sweden to assume responsibility for his case, Sweden Radio reported on Tuesday 11 March. The decision comes a few weeks after Norway, which is a signatory to the Dublin Agreements, because the first country to suspend the return of asylum seekers to Greece. (B.C.)
