14/09/2007 (Agence Europe) - Greece has been at daggers with the European Commission since 1994 over the scope, scale and nature of aid granted by Greek airline Olympic Airways. In a ruling issued on 12 September 2007 in case T-68/03, the European Court of First Instance annulled some of the Commission's 2002 decision finding Greece guilty and requiring the repayment of €41 million of undeclared aid deemed not to comply. The Court ruled that the Commission had been unable to demonstrate that the non-payment by Olympic Airways of various airport fees was supported by the state, nor that the non-payment of VAT had conferred any real economic advantage. The Court did, however, confirm the section of the Commission's decision condemning the restructuring plan submitted by Athens in 1998. The restructuring plan had failed to ensure Olympic Airways viability - a precondition for approval of state aid. (cd)
