28/06/2007 (Agence Europe) - In its ruling on Thursday 28 June in case C-466/03, the Court of Justice found in favour of the German company Albert Reiss, which had complained about paying the €11,424 demanded by the Amtsgericht Baden-Baden trade registrar for the authentification of shares. The Court says that this represents a tax that is disallowed under directive 69/335/EEC of the Council on indirect taxes and not authorised remuneration because: authentification is obligatory under German law: emoluments are proportional to the amount of the transfer and are not limited and that the notaries in question are officials employed by the civil authorities.
