Brussels, 28/06/2007 (Agence Europe) - The European Commission has closed its infringement procedure against Luxembourg, after the Grand Duchy complied with the Court of Justice ruling of 12 June 2003 on telecommunications markets. Luxemburg had hitherto failed to fully transpose the directive on competition in the markets for telecommunication services into national law, more particularly with regard to ensuring transparent and non-discriminatory procedures for to allow new entrants to obtain the necessary permits (“rights of way”) to install their infrastructure alongside roads and railways. On 16 December 2006, the Commission formally requested Luxembourg to comply with the Court ruling in a second infringement procedure (see EUROPE 9339). Luxemburg responded to this request by adopting two new regulations establishing transparent conditions of access to the public domain for all telecommunications operators, allowing them to set up their own networks.
