03/05/2007 (Agence Europe) - The Court of Justice's 3 May ruling confirmed the validity of the European arrest warrant as part of Community law (C-303/05). “Advocaten voor de Wereld” referred the case to the Belgian Court of Arbitration, which asked the Court of Justice about the legality of certain aspects of the warrant. The “double criminality” condition was withdrawn for certain offences, which means that the presumed perpetrator of a crime in a member state can now be arrested and extradited to another member state, even if the offence in question does not constitute a crime in the country where the accused is located. Advocaten voor de Wereld considered that this would have a harmful impact on defence law but the Court of Justice did not find any illegality in the Framework Directive or its transposition into Belgian law.
