Luxemburg, 13/07/2006 (Agence Europe) - The European Court of Justice has just rejected the European Commission's appeal against the European Court of First Instance ruling which, on 3 December 2003, annulled the decision imposing a fine of €31 million on the German car manufacturer Volkswagen for anti-competitive practices in its sales network in 1996 and 1997 (see EUROPE 8589). All the Commission's legal arguments were rejected. The Commission argued that the judgment under appeal was given in disregard of that case-law and was incompatible with the nature of selective distribution systems.
