Commission considers Microsoft proposal constructive but still needs more details

Brussels, 22/03/2006 (Agence Europe) - On Wednesday the spokesperson for the Commissioner for competition declared that at first glance, the Microsoft proposal appears “constructive” but that it would be insufficient if it was not accompanied by suitably technical documentation. At this stage the services of Neelie Kroes have not yet received details about the offer announced the same day by Microsoft, which includes the offer of free and unlimited technical support (as opposed to the 500 hours previously offered) to software programmers. Following criticism of its most recent technical documentation, described as being unusable (EUROPE 9149), the firm is said to have sent new draft amendments to the representative, Neil Barrett. The spokesperson explained that “technical support is only useful when documentation reaches a certain standard”. The spokesperson also stressed that two years after the March 2004 decision (EUROPE 9117, 9096, 8673), Microsoft is still not complying with its inter-operability obligations. The US company will have the opportunity to say how it will meet the demands included in a complaint sent out at the end of 2005, during a hearing planned for 30-31 March. If the Commission is not completely satisfied, it could impose fines on Microsoft that go up to € 2 million. Hearings at the Court of First Instance on the appeal lodged by Microsoft against the decision are planned for 24-28 April.
