Madrid must refrain from invoking a 1999 law authorising the Spanish government to intervene when a foreign company hopes to acquire a stake greater than 3% in a public company in the field of energy, a Commission spokesperson warned on Friday. The Commission declared this legislation "illegal" back in July 2003, he told the press, before a colleague added: "the Commissioner for the Internal Market, Charlie McCreevy, intends to bring Spain before the Court of Justice", probably in mid March.
