Brussels, 17/01/2005 (Agence Europe) - The European Commission has decided to send Reasoned Opinions to five Member States for failing to notify domestic legislation to transpose EU Directive 2003/49/EC and/or 2003/93/EC. It is taking Italy to the Court of Justice over Directive 2003/93/EC.
Directive 2003/49/EC aims to establish equal tax treatment of national and non-national business through a common system of taxation applicable to interest and royalty payments made between associated companies of different Member States. The Commission is sending a Reasoned Opinion on this issue to France, Greece, Italy and Portugal.
The European Commission has decided to take Italy to the Court of Justice for failure to notify it of measures transposing Directive 2003/93/EC which extends the provisions on mutual assistance by the competent authorities of the Member States to taxes on insurance premiums. At the same time, the Commission has decided to formally request Luxembourg, the Netherlands and Portugal to notify the measures they have taken to implement the Directive. The requests are in the form of reasoned opinions, the second stage of infringement proceedings under Article 226 of the Treaty.
