26/11/2004 (Agence Europe) - In the Microsoft case, the Court of First Instance will take account of reports from all parties, despite the withdrawal of most of the complaints (including those by CCIA and Novell at the beginning of November). Following a meeting in Luxembourg on Thursday, judge Bo Vesterdorf and the various parties agreed that the evidence supplied to date should be included in the case. This means that the Court of First Instance is likely to issue its ruling before the Christmas break on the request for a preliminary hearing lodged by Microsoft to suspend implementation of the Commission's decision of 24 March (see Europe of 25 November, p.12).
