Appeal by Willi Rothley and 69 other MEPs against OLAF ruling rejected

Luxembourg, 30/03/2004 (Agence Europe) - The European Court of Justice has just rejected the appeal by Willi Rothley and 69 other MEPs for the cancellation of the ruling by the Court of First Instance which, on 26 February 2002, rejected their appeal against the "OLAF" decision of the Parliament. This decision, which was taken further to the inter-institutional agreement of 25 May 1999 (Parliament, Council and Commission) on OLAF inquiries, allows agents of the European Anti-Fraud Office to carry out inquiries into members of the Parliament. The Court confirms what the Court of First Instance said, which is that the 70 MEPs were not individually involved; in other words, not more involved than other MEPs. "The contested measure also applies to other categories of persons defined generally and in the abstract such as all the Parliament's staff, whether subject to the Staff Regulations or not", said the Court.
