Brussels, 10/07/2003 (Agence Europe) - On Wednesday, the European Commission decided to refer Ireland and Luxembourg to the Court of Justice for failing to let it know their national measures for transposing the directive on seafarers' working hours. The directive, that the two States have still not transposed into national law, aims to improve maritime security and the living and working conditions of seafarers. According to the Commission, 80% of accidents are caused by human error which can be the result of great fatigue. For this reason, in some situations, the directive mainly allows the Member State authority of a port of call to issue a ban on leaving the port until the crew has taken sufficient rest. The directive, adopted in 1999, aims to make it an obligation for any vessel that stops over in a Community port to apply the working and rest periods that are established by Community legislation in conformity with the International Labour Organisation regulations.
