Brussels, 21/02/2003 (Agence Europe) - The European Commission is launching proceedings against seven Member States for failing to meet EU legislation concerning public tenders.
France. France is being taken to the Court of Justice over the French MOP law whereby companies have to be included in a list of contractors for major building projects
Portugal is being taken to the Court of Justice over the lengthy proceedings when challenging the award of a public tender
Germany is being taken to the Court of Justice since waste management contracts in Munich and Coesfeld were awarded without the required Europe-wide tendering procedure.
Spain is being taken to the Court of Justice over the conditions sets by the Instituto Nacional de Salud (national health service) for contracts to provide respiratory therapy in patients' homes.
Ireland. Ireland has been sent two formal requests over a contract to provide social welfare payment services by An Post (the national post office), and the supply of emergency ambulance services to the Eastern Regional Health Authority.
Italy is being sent a reasoned opinion concerning contracts awarded by ANAS, the public body responsible for managing the national road network to build a tunnel in the port of Olbia in Sardinia, and design work for a major road in Calabria.
Finland is being sent a reasoned opinion since the Commission believes that the award of a contract for kitchen equipment by the Finnish contracting authority in charge of government real estate (Senaattiikiinteistöt) should have been advertised.
