Luxembourg, 17/01/2003 (Agence Europe) - The Basque association SEGI (Organisation of Independent Revolutionary Youth) and its spokesperson Araitz Zubimendi Izaga, based in Hernani in Spain and Aritza Galarraga based in Senpere in France, are requesting the EU Court of the First Instance to condemn the Council of the EU and send EUR one million to each of the Basques for damages they claim to have suffered on 27 December 2001 when the Council of the EU included them on a list of individuals and groups associated with terrorism (see EUROPE 29 December 2001). The applicants claim that the Convention on Human Rights and their fundamental rights, such as the presumption of innocence, have been violated. They are also using the freedom of expression to defend the right of self-determination of the Basque Country and are seeking "a solution to the Basque conflict that is based on negotiation". The Basques have said that this procedure that has led that the EU Council to put this list together is illegal.
