Luxembourg, 11/10/2002 (Agence Europe) - Osman Öclan (the brother of Abdullah Öcalan), the former leader of the Kurdish Labour Party (PKK), calls on the European Court of First Instance to cancel the Council's decision that includes the Kurdish organisation on the list of terrorist organisations. Serif Vaniy, the president of the national Congress of Kurdistan, does the same. The Kurds believe the Council has banned an organisation that does not exist - as it was recently dissolved - and which cannot therefore carry out acts of terrorism either at present or some time hence. In their opinion, the Council, if it considers that the PKK continues to exist as an organisation, had the obligation to respect the condition whereby any organisation assumed to be terrorist must currently carry out terrorist activities. As this is not the case as, since July 1999, the PKK has stopped calling for the independence of Kurdistan, and has simply called for Kurdistan to be recognised by peaceful and political means, Osman Öcalan and Serif Vaniy consider that inclusion by the EU Council of the PKK on the list of terrorist organisations is due to political pressure from Turkey and is not the result of serious application of the criteria which should have taken precedence.
