The European Commission launched, on Wednesday 13 May, a call for evidence to gather comments from stakeholders until 25 June on possible targeted measures to modernise European copyright rules and ensure their application in the digital environment (see EUROPE 13867/12).
In particular, the Commission is studying ways to improve licensing mechanisms and the application of copyright and related rights in the context of artificial intelligence, to improve the conditions for remunerating creators, while facilitating access by providers of generative AI to content protected by copyright.
In order to meet the challenge of piracy, the Commission is also examining the possibility of strengthening the means of enforcement available to rightholders, particularly with regard to content broadcast live. With regard to the European music market, the institution is considering introducing the principle of material reciprocity in the application of the right to a single equitable remuneration. To facilitate the use of protected content in research, it is studying several options, including the possible introduction of rules allowing authors of scientific works to publish their research independently of the version published by scientific publishers, under certain conditions.
Preparatory work for a targeted legislative initiative will be carried out in parallel with the review of the 2019 Copyright in the Digital Single Market (CDSM) Directive, which will be supported by an external study currently in preparation.
