On Monday 4 May, the European Commission published a report on the implementation of the EU Deforestation Regulation aimed at combating imported deforestation, together with a number of measures designed to facilitate its application (see EUROPE 13857/17).
The package includes a report (https://aeur.eu/f/lsu ), updated guidelines, FAQs (frequently asked questions) and a draft delegated regulation adjusting the list of products concerned. The aim is to reduce the administrative burden, with an estimated 75% reduction in costs.
The draft delegated act (https://aeur.eu/f/lst ) introduces targeted changes to the scope of the products covered by the Regulation. It provides for the addition of certain downstream products, such as soluble coffee and certain palm oil derivatives. It also proposes a number of exclusions, including leather and retreaded tyres, as well as exemptions for product samples, certain packaging materials, second-hand products and waste. This project is open to public consultation until 1 June 2026.
At the same time, the Commission is updating the information system to take account of changes in the revised regulation and to make it more user-friendly. In particular, the updated draft implementing act provides for a simplified declaration form for micro and small primary operators, aligned with the existing format for due diligence declarations, updated specifications for automated interfaces, a continuity plan in the event of unforeseen unavailability, and a voluntary grouping feature, introduced at the request of industry.
