26/01/23 (Agence Europe) – On Thursday 26 January, the European Commission decided to refer Portugal to the Court of Justice of the European Union for incorrect transposition of the EIA Directive (2011/92), amended in 2014 by Directive (2014/52), which establishes an assessment of the effects of certain public and private projects on the environment (Directive 2011/92/EU). In its view, Portugal has not correctly transposed certain provisions of the amended Directive into national law by exempting too many projects from environmental assessment, and by not fully taking into account the criteria set out in EU law for determining whether certain projects (Annex II) should be subject to assessment.
