On Tuesday 15 November, the European Commission launched a consultation on a draft revision of the de minimis regulation.
Under the current rules, Member States can grant support of up to €200,000 per beneficiary over a period of three years (‘de minimis threshold’) without prior notification to the Commission for approval.
This amount is deemed to have no impact on competition and trade in the EU single market and is therefore not considered to be State aid. These rules are due to expire on 31 December 2023.
The Commission proposes to revise the de minimis threshold to adapt it to the current economic context and to improve transparency requirements by introducing a mandatory register of beneficiaries, which will reduce the administrative burden for companies currently using a self-declaration system.
All parties, in particular national authorities granting de minimis aid, may submit their views on the proposed revision from 15 November 2022 to 10 January 2023.
