French Presidency of EU Council proposes to move forward as soon as possible on modification of Eurojust’s mandate

On 25 April, the European Commission proposed to amend Eurojust’s mandate in order to facilitate investigations into war crimes, particularly in the context of the Russian invasion of Ukraine (see EUROPE 12938/9). The French Presidency of the Council of the EU (FPEU) circulated a document on Wednesday 27 April, of which EUROPE has a copy, which proposes a position to be adopted by the Member States. 

In line with the Commission’s request, France suggests moving quickly on adoption. In particular, it proposes to invoke a clause in the Treaties which allows, in case of urgency, not to wait for the eight-week period between the availability of the proposal in the official languages and the date of placing the proposal on the EU Council agenda for adoption. This eight-week period normally allows national parliaments to consult the act.

The proposal will be discussed at the ‘Justice and Home Affairs’ Council meeting on 29 April.

The FPEU stresses in the document the need for the rapid entry into force of the Regulation in order to “ensure accountability for the atrocities committed in Ukraine”.
