On Wednesday 16 September, the European Commission presented a delegated act to allow for increased production and commercial distribution of organic (and in-conversion) plant reproductive material.
Regulation 2018/848 on organic products, particularly Annex II, sets out certain requirements for the use of in-conversion and non-organic plant reproductive material.
However, the regulation on organic production provides for the phasing out of derogations from the use of organic plant reproductive material.
The delegated act allows producers to benefit from legal certainty with regard to the new rules that will apply to categories of plant reproductive material. Moreover, EU Member States must be given sufficient time to incorporate these new rules into their national legislation.
The new rules stipulate that, where organic and in-conversion plant reproductive material is not available in sufficient quality or quantity to fulfil the operator’s needs, the competent authorities may authorise the use of non-organic plant reproductive material under certain conditions.
