European Parliament’s Legal Service reaffirms its opinion rejecting use of delegated acts provided for in Climate Law

24/04/2020 (Agence Europe)According to a press release from the European Parliament’s ECR group issued on Friday 24 April, the institution’s legal service reaffirmed the conclusion of its legal opinion of 1st April that the use of delegated acts provided for in the Climate Law to set the EU’s climate trajectory after 2030 is incompatible with Article 290 of the Treaty on the Functioning of the EU (TFEU) (see EUROPE 12460/25, 12461/30). Believing that the opinionproves that the Commission is trying to act beyond its mandate”, ECR group MEPs called on the executive vice-president in charge of the Green Deal, Frans Timmermans, to withdraw the proposed Climate Law. On Tuesday, in an exchange with the Parliament’s Environment Committee (see EUROPE 12471/5), the latter expressed its readiness to discuss these concerns with Parliament.
