Imminent legislative proposal from European Commission on RDE tests

The Vice-President of the European Commission, Valdis Dombrovskis, announced on Wednesday 12 June that his institution's services were in the process of finalising a legislative proposal, in order to comply with the judgment of the General Court of last December

"Mr Maroš Šefčovič (Vice-President of the European Commission responsible for the Energy Union) informed us of the latest preparations for a legislative initiative on car emissions in response to the judgment of the General Court last December", said Mr Dombrovskis, reporting on the meeting of the European Commission's College. "We will propose to reinsert certain aspects of real-driving emissions tests into the legislation to be adopted by the European Parliament and the Council of the EU", he said, announcing that the text will be presented in the coming days.

This announcement follows the cancellation, last December, by the General Court (see EUROPE 12159/33) of the provisions of Regulation (2016/646) setting limits on nitrogen oxide emissions not to be exceeded during real driving emissions (RDE) tests. The General Court ruled in favour of the cities of Paris, Brussels and Madrid (see EUROPE 11549/17) - which questioned the compliance factors proposed by the Commission. For the General Court, the 'Euro 6' standard is an 'essential element' of Regulation 715/2007, which cannot be amended by the European Commission. (Original version in French by Pascal Hansens)
