The acquisition of a permanent right of residence is a prerequisite for a citizen of the European Union to be able to benefit from enhanced protection against expulsion, the EU Court of Justice ruled on Tuesday 17 April (joint affairs C-316/16 and C-424/16).
In the first case, an Italian national settled in the United Kingdom since 1985 received an eight-year prison sentence in 2002 for homicide. After being released in 2006, he was subject to an expulsion decision in 2007.
