Company cannot oppose import of products under its trademark if that trademark is single and global

In a judgment returned on Wednesday 20 December (case C-291/16), the Court of Justice of the European Union (CJEU) ruled that Schweppes cannot oppose imports to Spain from the United Kingdom of bottles of tonic water bearing the trademark Schweppes if it has itself given the impression that the trademark is a single, global one.

Schweppes International Ltd holds exclusive rights to operate the trademark Schweppes in Spain.  It initiated infringement proceedings in 2014 against the company...
