28/03/2017 (Agence Europe) – Are the Commission guidelines on market analysis and the evaluation of operators with significant market power (SMP operators) still appropriate? This is the question raised by the European Commission in its public consultation open from 27 March to 26 June. This consultation is part of the review of the electronic communications code. Guidelines were drawn up to help the national regulatory authorities identify the existence of an SMP operator in the telecommunications field, in view of ensuring that they are subject to appropriate obligations for rectifying competition problems that may have been identified. Their update intends to take into account the changes in the telecommunications market, as well as recent developments in the regulatory framework and competition. (SPj)
