07/09/2016 (Agence Europe) – On Wednesday 7 September, the Court of Justice of the EU ordered Greece (Case C-584/14) to pay a fixed fine of €10 million and a fine of €30,000 for every day of delay in its failure to execute its judgement of 2009 (C-286/08), in which it found the member state to be in breach of the directives on waste (2006/12/EC), hazardous waste (91/689/EC) and the landfill of hazardous waste (1999/31/EC). Following up on a second action for failure to fulfil obligations that was lodged by the Commission in 2014, the Court noted that by the deadline of 25 March 2013 laid down in the 2009 judgement, Greece had still not adopted a specific plan for the management of hazardous waste, set in place an integrated and adequate network of installations for the disposal of hazardous waste or implemented a system to manage old waste temporarily stored in sites not designated for that purpose ("historical waste"). In view of the total delay and dangers to human health and the environment likely to be caused by its failure to set these measures in place, the Court decided to apply a daily fine and a fixed fine aiming to prevent a repetition of these infringements in the future.
