14/04/2016 (Agence Europe) - Advocate General proposes Pilkington appeal rejection. The Advocate General, Juliane Kokott, suggested to the European Court of Justice on Thursday 14 April, that it should reject the appeal made by the British Pilkington group (C-101/15 P) and subsequently maintains the fine imposed on the group by the European Commission in 2008 (revised in 2013 to €370 million) for its participation in the Car Glass Cartel (see EUROPE 9781). The Advocate General believes that the Commission's decision was correct and had taken into account the calculation of the fine; the deliveries made by Pilkington, on the basis of contracts dating back to before the beginning of the infringement and on the basis of the calculation of the fine, had carried out the conversion of the British pound into euros on the basis of the exchange rates applicable during the final tax year when the group had closed its accounts and not on the basis of the rate applicable the day of the adoption of the Commission decision.
