Brussels, 25/02/2016 (Agence Europe) - As the fourth railway package is making its way along the legislative process, the European Commission referred Portugal to the Court of Justice of the EU on Thursday 25 February for failing to comply with a ruling dating from 2012 (case C-557/10) for its failure to implement provisions in the first railway package, which was adopted in 2001 - those on balancing the accounts of rail infrastructure managers.
Having determined that Portugal has yet to comply, the Commission is calling on the Court to impose a lump sum from the date of the first judgment “until Portugal has rectified the infringement”. This sum now stands at €5,385,995, the Commission says.
It is also proposing a daily fine of €40,401 to be paid from the date of the second Court ruling until Portugal correctly complies with EU law.
It is now for the Court to determine the final penalties. (Original version in French by Pascal Hansens)
