Three countries referred to court for road transport regulation non compliance

Brussels, 22/10/2015 (Agence Europe) - On Thursday 22 October, the Commission announced that Luxembourg, Portugal and the Czech Republic had been referred to the Court of Justice of the EU for not having established national electronic registers of road transport undertakings and/or for not having connected them with the national electronic registers of the other member states.

The three member states being singled out have not correctly transposed Article 16 of Regulation (EC) No 1071/2009 on the conditions to be respected by the road transport profession as set out in the national registers by 31 December 2012 at the latest.

As part of their respective national competences, these registers should have been connected to each other and accessible throughout the Community by way of the appropriate national contact point intermediary appointed by the member states to facilitate the exchange of information between other member states and the Commission. The data requiring submission includes the number and kind of infringements, as well as the charges imposed on the transport company in question over the past two years. The name of the people that have been declared unfit to ensure the management of a transport company's activities also needs to be included on the register.

By failing to comply with the regulation, these three member states are undermining the interconnection efficiency of the registers at a European Union level and are subsequently preventing optimum transparency in the information required to ensure the appropriate functioning of the internal market, explained the Commission.

The interconnection of national registers is necessary for tackling possible infringements committed by companies carrying out haulage or passenger transport at international level (such as exceeding allowed driving times or tachograph fraud). (Original version in French by Pascal Hansens)
