26/11/2014 (Agence Europe) - Formal request sent to Finland. On Wednesday 26 November, the Commission sent a formal request urging Finland to take the necessary actions to ensure that appeals against a decision to refuse, annul or revoke a visa include access to a judicial body. The Visa Code Regulation sets out the procedures and conditions for issuing visas for the purpose of short stays and airport transit. It establishes the obligation for member states to provide for a right of appeal against a visa refusal/annulment/revocation. The EU Treaty also obliges member states to provide remedies sufficient to ensure an effective legal protection. National law in Finland only provides for the possibility for an appeal before non-judicial administrative authorities. (SP)
