Brussels, 20/11/2013 (Agence Europe) - On 20 November, the European Commission decided to refer Austria to the Court of Justice for its incomplete transposition of Directive 2009/28/EC on the promotion and use of renewable energy sources, which should have been fully transposed by 5 December 2010.
The Commission proposes a daily fine of €40,512. If the Court rules in favour of the executive, these daily fines, the level of which will be definitively set by the Court, will be payable from the date of the ruling and until the transposition of the text is complete.
Although it has adopted a considerable number of legislative provisions required by the directive, Austria has still not transposed the provisions on the management of network access for green electricity or on sustainability criteria for bio-fuels and bio-liquids into its national law.
